Slaughter, Reagan & Cole, LLP partner Barry Reagan and associate Bert Partida successfully defended a commercial landlord against claims of breach of contract and retaliatory eviction at trial in Ventura County Superior Court. The jury returned a complete defense verdict for landlord. The tenant plaintiff sued his landlord for breach of contract, retaliatory eviction, and conversion claiming that the landlord failed to perform work at the property. Plaintiff further claims to have complained to the city about conditions at the property and was subsequently evicted in retaliation for his complaints. He claims that his possessions were wrongfully converted after being evicted.
Plaintiff initially claimed damages in excess of $1,000,000.00 for losses suffered to his business from being evicted. The claim for conversion was dismissed on Summary Adjudication. After proceeding to trial, plaintiff’s expert opined that lost profits to plaintiff’s business exceeded $600,000.00. Mr. Reagan successfully refuted the amount of claimed loss of profit through his defense expert and prevented plaintiff from amending the complaint to conform to proof. After a nine-day jury trial, the jury returned a verdict in favor of defendant, awarding the plaintiff nothing.
