Barry Reagan Obtains Non-Suit Judgment

Slaughter, Reagan & Cole, LLP partner, Barry Reagan, successfully obtained a non-suit judgment. Plaintiffs sued the firm’s Homeowners Association client for property damage arising a common area roof leak and common area plumbing line leak. Plaintiffs sought property damage, loss of use and attorneys’ fees. Plaintiffs waived their personal injury claims before trial. Following plaintiffs’ presentation of evidence, Mr. Reagan moved for non-suit. A Los Angeles Superior Court Judge granted the motion finding that plaintiffs failed to present admissible evidence of negligence or breach of the CC&Rs by the firm’s client. Plaintiffs’ further failed to present evidence of the cause of the roof leak and plumbing line leak. The Court granted a non-suit defense judgment.
