Barry Reagan and Michael Lebow Obtain Defense Judgment
Slaughter, Reagan & Cole, LLP partner, Barry Reagan, and associate, Michael Lebow, successfully obtained a defense judgment in the Ventura County Superior Court. The firm represented three volunteer board members and a homeowners association being sued for breach of fiduciary duty, breach of contract and other causes of action relating to a claim by a plaintiff that the clients breached their fiduciary duty by allowing homeowners to operate a business in contravention of the CC&Rs. The homeowners association and board of directors took the position that the homeowners were not violating the “no business” provision in the CC&Rs and that their decisions were protected by the Business Judgement Rule. The trial court agreed that the homeowners association proved their affirmative defense of Business Judgment Rule. A complete defense judgment was rendered. The firm’s clients were awarded attorneys’ fees.
