Slaughter, Regan & Cole, LLP partner, Barry Reagan, and associate, Elyse Scofield, successfully defended their client in a Santa Barbara Superior Court lawsuit alleging traumatic brain injury and cervical spine injury. In the case, the plaintiff fell from a ladder offered by the firm's client. Plaintiff claimed the ladder was defective. Plaintiff claimed he suffered traumatic brain injury, cervical spine injury, thoracic back injury, hearing injury and neuro-cognitive deficits. At trial, both sides called many expert witnesses including, neurologists, neuro-psychologists, neuro-radiologist (defense only), orthopedic surgeons, safety experts and economists/accountants.
Plaintiff requested damages over $3,000,000.00 for past and future medical expenses, loss of earnings for remainder of working life and past and future pain and suffering. Following an 11 day Court trial, plaintiff was found 90% at fault for his own injuries. The Court rejected plaintiff's claim of traumatic brain injury. The Court further rejected claims for future surgeries and claims for future loss of income. Plaintiff was awarded the sum of $35,000. Plaintiff's Motion for New Trial was denied.
